These Terms of Use ("Terms") govern your use of the ReCap mobile application ("App") and related services ("Service") provided by ReCap ("we", "us", or "our"). By accessing or using ReCap you agree to be bound by these Terms.
You must be at least 13 years old to use ReCap. By using the App you represent that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
You may use ReCap anonymously or by registering with an email address. You are responsible for keeping your sign-in email secure. You may not share your account or allow others to access it on your behalf. You are responsible for all activity that occurs under your account.
Private albums. Albums are private by default. Only users who have the album's invite code can join and view its contents.
Your content. You retain ownership of photos and videos you upload. By uploading content to ReCap you grant us a limited, non-exclusive licence to store, display, and process that content solely for the purpose of operating the Service (including displaying photos to other album participants and running on-device face grouping).
Expiry. Albums and all their contents are automatically deleted 30 days after creation, unless extended. Once deleted, content cannot be recovered. Save anything you want to keep before the expiry date.
You agree not to use ReCap to:
ReCap provides an in-app reporting feature. If you see content that violates these Terms you can report it directly from the photo viewer. We review reports and may remove content or suspend accounts that violate these Terms.
ReCap may offer optional paid features (such as album extensions). All purchases are processed through Apple's App Store and subject to Apple's payment terms. We do not handle payment information directly. All sales are final unless required otherwise by applicable law.
The ReCap name, logo, design, and all original content within the App (excluding user-uploaded content) are our intellectual property. You may not use, copy, or reproduce them without our prior written permission.
ReCap is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We are not responsible for any loss of data due to expiry, deletion, or technical failure.
The face-grouping feature uses on-device machine learning and may produce inaccurate results. It is provided for convenience only and should not be relied upon for any purpose requiring accuracy.
To the fullest extent permitted by law, ReCap and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
We may suspend or terminate your access to ReCap at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may stop using the Service and delete your account at any time through the app settings.
We may update these Terms from time to time. We will post the updated Terms at this URL with a new effective date. Your continued use of ReCap after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
